This agreement applies as between you, the User of this site and Log Cabins South West. If you do not agree to be bound by these Terms and Conditions, you should NOT place any orders on this site.

No part of this Web Site is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a dispatch email to you indicating that your order has been fulfilled.

1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings: 
Carrier means any third party responsible for transporting purchased Goods from our Premises to customers;

Content 

means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

Goods
means any products that advertises and / or makes available for sale through this Web Site;

This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;

Purchase Information
means collectively any orders, invoices, dispatch notes, receipts or similar that may be in hard copy or electronic form;

Premises 

means our place of business located at Bodmin, Cornwall.

System
means any online communications infrastructure Log Cabins South West makes available through the Web Sites either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

User / Users
means any third party that accesses the Web Site and is not employed by Log Cabins South West.

2. Age Restrictions 

Persons under the age of 18 should use this Web Site only with the supervision of an Adult. Payment Information must be provided by or with the permission of an Adult.

4. International Customers
If Goods are being ordered from outside the UK, import duties and taxes may be incurred once your Goods reach their destination. Log Cabins South West is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and Log Cabins South West cannot guarantee that the packaging of your Goods will be free of signs of tampering.



5. Intellectual Property
5.1 All Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Log Cabins South West , our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable UK and International intellectual property and other laws.


5.2 You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Log Cabins South West 
BREACHING THIS WILL RESULT IN IMMEDIATE ACTION BEING ENFORCED AGAINST YOU.

6. Use of Communications Facilities
6.1 When using the enquiry form or any other System on the Web Site you should do so in accordance with the following rules:
6.1.1 You must not use obscene or vulgar language
6.1.2 You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
6.1.3 You must not submit Content that is intended to promote or incite violence;
6.1.4 It is advised that submissions are made using the ENGLISH language as we may be unable to respond to enquiries submitted in any other languages;
6.1.5 The means by which you identify yourself must not violate these terms of use or any applicable laws;
6.1.6 You must not impersonate other people, particularly employees and representatives of Log Cabins South West or our affiliates;
6.1.7 You must not use our System for unauthorised mass-communication such as spam or junk mail.
6.2 You acknowledge Log Cabins South West reserves the right to monitor any and all communications made to us or using our System.

7. Termination and Cancellation
7.1 Log Cabins South West reserves the right to cancel purchases without stating reasons, for any reason prior to processing payment and dispatch.
7.2 If purchases are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases.

8. Goods, Pricing and Availability
8.1
Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from Log Cabins South West correspond to the actual Goods, Log Cabins South West is not responsible for any variations from these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether. Please refer to Clause 15.1 for incorrect Goods.
8.2 Where appropriate, you may be required to select the required size, model, number and log thickness of the Goods that you are purchasing.

8.3 Log Cabins South West does not represent or warrant that such Goods will be available. Stock indications *are not* provided on the Web Site.
8.4 All pricing information on the Web Site is correct at the time of going online. Log Cabins South West reserves the right to change prices and alter or remove any special offers from time to time and as necessary. All pricing information is reviewed and updated regularly.

8.5 In the event that prices are changed during the period between an order being placed for Goods and Log Cabins South West processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price;
8.6 All prices on the Web Site include VAT @ 20%

9. Privacy
Use of the Web Site is also governed by our Privacy Policy which is incorporated into these terms and conditions by this reference.

10. Disclaimers 

10.1 Log Cabins South West makes no warranty or representation that the Web Site will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Services.
10.2 No part of this Web Site is intended to constitute advice and the Content of this Web Site should not be relied upon when making any decisions or taking any action of any kind.
10.3 No part of this Web Site is intended to constitute a contractual offer capable of acceptance.
10.4 Wood is a natural raw material. It is subject to weathering and sometimes fungal attack. While we recommend various treatments, we cannot be held responsible for those natural processes should they occur.

11. Changes to the Service and these Terms and Conditions
Log Cabins South West reserves the right to change the Web Site, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Web Site following the changes. If Log Cabins South West is required to make any changes to Terms and Conditions relating to sale of Goods by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

12. Availability of the Web Site
The Service is provided as is and on an as available basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. 
Log Cabins South West accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

13. Limitation of Liability
13.1 To the maximum extent permitted by law, Log Cabins South West accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.
13.2 Nothing in these Terms and Conditions exclude or restricts Log Cabins South West liability for death or personal injury resulting from any negligence or fraud on the part of Log Cabins South West
13.3 Nothing in these Terms and Conditions excludes or restricts Log Cabins South West liability for any direct or indirect loss or damage arising out of the incorrect delivery of Goods or out of reliance on incorrect information included on the Web Site.
13.4 Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

14. No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

15. Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

16. Notices
All notices / communications shall be given to us either by post to our Premises (see address above) or by email to [email protected]

17. Care
Always check there are no overhanging branches or leaves above your building, this can wear away the felt or break off and damage the roof. Check you have no puddles of water collecting under your shed. All furniture must be oiled on a regular basis. Silicone seals around doors and windows may need to be replaced when required. Please allow adequate space around your building for future maintenance. Also gutters can be fitted, this stops drips of water being blown on to the building, and also stops splash back onto the bottom of the building. If your sectional building is erected in damp inclement conditions, you must ensure you leave adequate ventilation to allow the sectional building to dry. If you fail to ventilate the building whilst timbers are drying out, condensation will occur. This will produce drips or runs of water inside the building, which may be mistaken for leaks. Condensation will also build up on the inside of the windows. We use 38kg heavy duty felt, this is the best on the market because it is manufactured with tar and oil, It can move with atmospheric conditions, this is out of our control. We felt the buildings in a way that has been tried and tested by the company for over twenty years. Roof is always larger than building size.

BUILDINGS ARE NORTH COAST LOG CABINS PROPERTY UNTIL FULL PAYMENT IS RECEIVED AND CAN BE RECLAIMED AT ANY TIME. DEPOSIT/PAYMENT IN FULL:For orders offline a non refundable deposit is required at the lime of order. Full payment must be received within 72 hours before delivery or your building will be put on hold. For orders online placed using this website full payment is made using Sagepay.

DELIVERY: If you require the building to be delivered to the rear garden, please advise of any difficulties, e.g. overhead obstructions, walls, hedges etc. Failure in not having clear access may result in an additional charge plus 10% of the building cost, deliver only service will be to the front of the premises only.

PLANNING: Please note that all none residential Log Cabins are built to our specification, the plans of said structure will be sent to you for you to sign off on. If this building is to be used as a habitable dwelling it will not comply with Part M building regulations. Where building regulations may occur please inform us in writing before pricing and deposits are paid and provide all architects plans, specifications, as our Log cabins do not conform with buildings regulation. We are able to offer this service if asked however additional costs may occur. We are always willing to help in any way we can. It is the customers sole responsibility to check with their local planning authority regarding planning permission for their sectional building / log cabins to be erected. North Coast Log Cabins will not be held responsible for any problems regarding planning permission (if applicable).

SITE PREPARATION FOR ERECTION SERVICE: It is the responsibility of the customer to ensure that the site is safe and free from obstructions that may cause injury to the persons that delivers and erects the building. BASE: It is the responsibility of the our customers to ensure the completed base Is firm, level and of adequate size to take the building. North Coast Log Cabins will not be held responsible for any problems arising due to faulty base work constructed by the purchaser.

FAILURE IN NOT HAVING A SUITABLE LEVEL BASE WILL RESULT IN AN ADDITIONAL CHARGE IF WE ARE CALLED TO RE ERECT, YOUR GUARANTEE WILL BE VOID IF NORTH COAST LOG CABINS PERSONNEL DO NOT ERECT THE BUILDING WE DO NOT ACCEPT LIABILITY FOR ANY DAMAGE CAUSED BY CUSTOMER IN SELF ERECTION. THE ERECTION SERVICE WILL BECOME VOID IF WE CANNOT DELIVER AND ERECT AT THE SAME TIME. NORTH COAST LOG CABINS LTD WILL NOT BE RESPONSIBLE FOR ANY DAMAGE CAUSED BY ADVERSE WEATHER CONDITIONS. AS TIMBER IS A NATURAL PRODUCT THIS COMPANY CANNOT BE HELD RESPONSIBLE FOR CRACKS, SHRINKAGE, KNOTS OR MOVEMENT IN OUR BUILDINGS. NORTH COAST LOG CABINS WILL NOT ACCEPT ANY RESPONSIBILITY FOR MOVEMENT WITHIN THE FELT, AS THIS IS OUT OF OUR CONTROL.

North Coast Log Cabins will have the right to adjust any delivery date following any unforeseen circumstance.

PAYMENT: Online payments are made in full at time of order using a credit or debit card. For offline payments the balance cash/cheque or credit card to be paid 72 hours before delivery.

ALL BUILDINGS INCLUDING BEACH HUTS AND GARAGES ARE NOT SECURED DOWN TO BASES. THIS IS THE CUSTOMERS RESPONSIBILITY It is recommended that in very open/exposed areas you strap down the building.

D.P.C is the customers responsibility.

When an order has been placed it is the customers responsibility to telephone the head office to arrange the delivery date. Customers must phone head office on the morning of delivery to be given an A.M. or P.M. time slot.

North Coast Log Cabins will not be liable for any problems arising from upgraded alterations by the customer to the exterior or interior of the building.

IMPORTANT CUSTOMERS RESPONSIBILITIES

Please ensure access is clear i.e. no overhead cables, brick arches or obstructions of any sort. If we have to return to erect the building due to poor base/ poor access or any other reason out of our control, a £35 call out, plus 10% of the building cost will be charged to return to erect the building. Please ensure your base is solid, flat and level. All concrete bases or slab bases must not have shallow or raised areas. Size quoted is the floor size so please allow a roof overhang of 12 inches for workshops, summerhouses, garages and custom builds. Please make sure area around the roof and building is clear as stated. Please remember you may need future access to side of your building to treat it. The base is to be the size of the floor with no obstructions i.e. branches, gutters or walls. Our floors are manufactures with tanalised bearers which will sit on a concrete and slab base perfectly, which will give you a 3 inch dry air flow. Alternatively if you must lay a bearer base (not recommended), you may use 6 Inch by 4 inch timbers laid short way across every 2 foot. This area must be perfectly level and on an even plain. this applies up to 10ft X 12ft area. Larger bases, your bearers must run the long way and must be made of heavier timbers i.e railway sleepers, every 2 foot. If you have any queries please do not hesitate to contact us.

GUARANTEE CONDITIONS – CARE & TREATMENT OF YOUR INTERNAL OR EXTERNAL DOORs AND WINDOWS
 
We take great pride in sourcing the very best products to cater for the widest range in tastes. The care taken during manufacture and the quality of the raw materials used ensures that your doors and windows will give many years of good service, providing they stored correctly and treated properly. Every single door and window are guaranteed for 12 months from the date of purchase against faulty material or manufacture, so long as it is treated in accordance with our instructions. Our ironmongery is also guaranteed for 12 months.
 
PLEASE CHECK YOUR GOODS!
 
When signing for receipt of your doors, windows and/or ancillary items, “unchecked” or similar annotations will not be accepted and we will accept no liability for any shortage or damage subsequently discovered. Visible damage must be detailed and noted clearly by you at the time of receipt on the Delivery/Receipt Note for any claim to be entertained. The Company accepts no liability if costs are incurred by booking a carpenter before having received and checked all goods.
Any claims for damaged goods – or where goods supplied are not those ordered – must be reported within 3 working days of receipt. Just because the door snad windows may be nicely wrapped doesn’t mean that you don’t have to check it!
Every effort is made to supply you with the correct doors and windows in perfect condition. However, on occasion, errors are made or a door or window is not up to standard. It is imperative that you check your doors and windows for any of the following potential faults prior to commencing any alterations:
  • Visible damage i.e. scratches, dents or chips
  • Warping or bowing beyond the 4mm tolerance
  • Scratches on glass (if supplied)
  • Wrong door, window or size supplied
The above are examples of potential faults/errors but this list is not exhaustive.
Please remember that, by fitting or finishing your door or making alterations in any way, you will be deemed to have accepted the goods as supplied. Unfortunately, we cannot replace a faulty or incorrectly supplied door if ANY alterations have been carried out. Please remember that just because you may not be the one fitting it doesn’t excuse you from checking!
 
STORAGE, SITE & INSTALLATION
 
Prior to fitment the doors and windows must be stored in a cool, dry atmosphere and kept flat.
An internal door is suitable for internal use only and must not be exposed to moisture in any way. Equally, an external door has been designed solely for use externally and must not be fitted inside. Doors must not be hung in damp or newly plastered rooms or suddenly exposed to central heating or other forms of direct heat. Caution should be taken fitting doors on freshly screeded floors and in double-glazed porches and conservatories that are prone to extremes of heat or humidity. Avoid placing and fitting doors and winodws close to radiators as this will warp or bow your door and winodws. Kitchens and bathrooms should be well ventilated to prevent prolonged periods of exposure to moisture.
These doors and winodws are quality pieces of furniture, please treat them with care!
 
MAKING ALTERATIONS
 
If you’ve bought a door that is sold as fully finished, you must re-seal any edges and cavities or cut-outs immediately after having made any alterations. The top and bottom of the door are often overlooked but must be done, even if it involves taking the door down for a short while. To properly finish your door requires 3 coats of an appropriate product.
 
MAINTENANCE & FINISHING
 
Most of our external doors, frames and winodws are sold unfinished, meaning that they need to be stained, varnished or painted after purchase. It is vital that the door, frame and winodws are sealed properly. Try to use a branded well known finishing product. We recommend and sell Sikkens treatments but Dulux, Jotun or Sadolin are fine too. Use as many coats as the manufacturer recommends but to check that you have done a good job, spray a little water on the door and see that the water forms beads and runs off. If it doesn’t then apply another coat or two. Don’t forget to seal the areas that you can’t see such as the tops and bottoms and inside lock and letterbox cut-outs.
Many of our internal doors are sold unfinished too. These need to be sealed straight away to stop the timber drying out and splitting or taking in moisture that is in the air. It is just as important to seal the tops and bottoms when fitting doors internally. Our manufacturers don’t accept Waxing or Oiling a door as appropriate methods of sealing so we cannot provide a guarantee for any door which has been treated in this way.
The top and bottom of the door are often overlooked but must be done, even if it involves taking the door down for a short while. This is particularly important for sealing the end grain which acts like a sponge and soaks up any moisture, causing a door to swell and split. Equally, egress of moisture can cause timber to crack/split and bow.
 
PROTECTION OF DOORS IN EXPOSED LOCATIONS & ONGOING MAINTENANCE OF EXTERNAL DOORS
 
We cannot guarantee an external door or window that is fitted in an exposed location with no protection from the elements. Correct initial treatment and regular maintenance are essential. After installation and at least once a year, lightly sand and apply a further coat of the finishing treatment to protect the fibres of the timber from deterioration and discolouration. The aim is to keep any water from penetrating your door. If you notice areas that need attention please treat them immediately. Once your door or window has been treated, for further protection you should apply a bead of clear silicone around all external glazing apertures. Please bear in mind that timber is a natural material which is subject to changes in temperature and humidity. We cannot accept liability for natural movement or distortion, warping, swelling or splitting which is caused by the door or window being exposed to extremes of temperature or humidity, or if the door or window is not correctly stored, treated or hung. A bow of 5mm along the length of the door or window is not unusual and is deemed to be within manufactured tolerances. Please note that pine is prone to small “shakes” or splits appearing. This is part of the beauty of the timber and is not considered a defect. Any flaws that appear after installation should be filled and re-finished promptly.

Warranty:
All products are guaranteed for a period of 12 months from date of purchase. This is a parts-only guarantee, and no labour or installation costs are covered. Apparent defects must be notified to the Company in reasonable time, normally no later than 2 working days from delivery.

Parts must be treated with good quality preservative and maintained correctly as written in our construction guides. All windows and doors must have multiple coats inside and outside on all surfaces to seal them from the elements. Failure to do this will invalidate any warranty.

If we construct the cabin we offer a 6 month workmanship guarantee. Failure to inform us of any workmanship issues later than 14 days after the Customer becomes aware or ought to have become aware of the defect in such Goods from Company’s works in reasonable time will invalidate any workmanship warranty.

These Terms and Conditions do not affect your statutory rights as a consumer.
